Algemene Voorwaarden The Love Doctor NEDERLANDS

Deze Algemene Voorwaarden zijn van toepassing op alle diensten, evenementen en overeenkomsten aangeboden door The Love Doctor.

Artikel 1 – Definities

The Love Doctor: de eenmanszaak The Love Doctor, eigendom van Demi Drenth, gevestigd in Nederland, ingeschreven bij de Kamer van Koophandel onder nummer 98887661, BTW-nummer NL005360637B06.

Deelnemer: iedere natuurlijke persoon die deelneemt aan een singles event of een matchmakingdienst afneemt bij The Love Doctor.

Evenement: een door The Love Doctor georganiseerd singles event, borrel of bijeenkomst.

Matchmakingtraject: een persoonlijk en individueel begeleidingstraject gericht op het vinden van (mogelijke) matches.

Overeenkomst: iedere overeenkomst tussen The Love Doctor en de Deelnemer met betrekking tot evenementen of matchmakingdiensten.

Artikel 2 – Toepasselijkheid

  1. Deze Algemene Voorwaarden zijn van toepassing op alle aanbiedingen, diensten, overeenkomsten en rechtsverhoudingen tussen The Love Doctor en de Deelnemer.

  2. Afwijkingen van deze Algemene Voorwaarden zijn uitsluitend geldig indien deze schriftelijk zijn overeengekomen.

  3. Door deelname aan een evenement of het aangaan van een matchmakingtraject verklaart de Deelnemer akkoord te gaan met deze Algemene Voorwaarden.

Artikel 3 – Diensten

  1. The Love Doctor biedt uitsluitend de volgende diensten aan:

    • Singles events;

    • Persoonlijke matchmakingtrajecten.

  2. The Love Doctor heeft een inspanningsverplichting en nadrukkelijk geen resultaatsverplichting.

Artikel 4 – Singles Events

Deelname

  1. Deelname aan een evenement is uitsluitend mogelijk na aanschaf van een geldig ticket.

  2. Tickets zijn persoonlijk, niet overdraagbaar en mogen niet worden doorverkocht.

Tickets, annulering en no-show
3. Alle tickets zijn NON-refundable.
4. Een aangeschaft ticket kan niet worden geannuleerd, niet worden verplaatst naar een ander evenement en niet worden omgezet.
5. Bij verhindering of no-show van de Deelnemer vindt geen restitutie of compensatie plaats.

Annulering of wijziging door de organisatie
6. Indien The Love Doctor een evenement annuleert of verplaatst, heeft de Deelnemer geen recht op restitutie.
7. In dat geval mag de Deelnemer het ticket eenmalig inwisselen voor deelname aan een toekomstig evenement van The Love Doctor.

Artikel 5 – Doelgroep, toelating en gedrag

  1. Evenementen zijn bedoeld voor een vooraf bepaalde doelgroep, zoals gecommuniceerd bij het betreffende evenement.

  2. The Love Doctor behoudt zich het recht voor om Deelnemers te weigeren of uit te sluiten indien zij niet binnen de doelgroep vallen of onjuiste of onvolledige informatie verstrekken.

  3. Deelnemers dienen zich respectvol te gedragen tegenover andere deelnemers, de organisatie en de locatie.

  4. Bij ongepast, grensoverschrijdend of storend gedrag behoudt The Love Doctor zich het recht voor de Deelnemer direct van het evenement te verwijderen, zonder restitutie.

Artikel 6 – Aansprakelijkheid bij evenementen

  1. Deelname aan evenementen geschiedt volledig op eigen risico.

  2. The Love Doctor is niet aansprakelijk voor:

    • persoonlijk letsel;

    • verlies van of schade aan eigendommen;

    • gedrag van andere deelnemers;

    • emotionele schade, teleurstelling of ongemak.

Artikel 7 – Matchmakingtrajecten

  1. Matchmaking is een persoonlijke dienstverlening waarbij The Love Doctor zich inspant om mogelijke matches te vinden.

  2. The Love Doctor:

    • garandeert geen minimum aantal matches;

    • garandeert geen succesvolle match;

    • garandeert geen relatie.

  3. Het is mogelijk dat geen enkele match wordt voorgesteld.

  4. De Deelnemer erkent dat matchmaking subjectief is en afhankelijk is van beschikbaarheid, wederzijdse interesse en persoonlijke voorkeuren.

Artikel 8 – Duur en verlenging matchmaking

  1. Matchmakingtrajecten hebben een overeengekomen indicatieve looptijd.

  2. Indien The Love Doctor van oordeel is dat meer tijd nodig is om het traject zorgvuldig uit te voeren, is zij gerechtigd het traject te verlengen zonder extra kosten.

  3. Een verlenging geeft geen recht op restitutie.

Artikel 9 – Betaling matchmaking

  1. De Deelnemer is verplicht het volledige bedrag van het overeengekomen matchmakingtraject te voldoen.

  2. Deze betalingsverplichting blijft bestaan:

    • ook indien de Deelnemer tijdens het traject een partner vindt;

    • ook indien de Deelnemer het traject voortijdig beëindigt.

  3. Na aanvang van het traject vindt geen restitutie plaats.

  4. Betaling in termijnen ontslaat de Deelnemer niet van de verplichting tot volledige betaling.

Artikel 10 – Beëindiging matchmaking

  1. The Love Doctor is gerechtigd het matchmakingtraject te beëindigen indien:

    • de Deelnemer onjuiste of onvolledige informatie verstrekt;

    • de Deelnemer afspraken niet nakomt;

    • sprake is van ongepast of grensoverschrijdend gedrag.

  2. Beëindiging door de Deelnemer of door The Love Doctor geeft geen recht op terugbetaling, tenzij The Love Doctor schriftelijk anders beslist.

Artikel 11 – Aansprakelijkheid algemeen

  1. De aansprakelijkheid van The Love Doctor is te allen tijde beperkt tot het bedrag dat door haar aansprakelijkheidsverzekering wordt uitgekeerd.

  2. Indien geen uitkering door de verzekering plaatsvindt, is de aansprakelijkheid beperkt tot het factuurbedrag van de betreffende dienst.

  3. Aansprakelijkheid voor indirecte schade, gevolgschade of immateriële schade is uitgesloten.

Artikel 12 – Overmacht

  1. Onder overmacht wordt verstaan iedere omstandigheid buiten de wil en controle van The Love Doctor, waaronder begrepen maar niet beperkt tot ziekte, overheidsmaatregelen, pandemieën, extreme weersomstandigheden, brand, technische storingen en uitval van locaties.

  2. In geval van overmacht is The Love Doctor niet gehouden tot enige vorm van schadevergoeding of restitutie.

  3. Indien mogelijk zal The Love Doctor een alternatief aanbieden, zoals doorschuiven van deelname naar een toekomstig evenement.

Artikel 13 – Beeldmateriaal

  1. Door aanschaf van een ticket voor een singles event verleent de Deelnemer toestemming voor het maken en gebruiken van foto’s en video’s voor marketing- en promotionele doeleinden.

  2. Deze toestemming wordt verleend zonder recht op vergoeding.

  3. Indien de Deelnemer zwaarwegende bezwaren heeft tegen herkenbare publicatie, dient dit voorafgaand aan het evenement schriftelijk te worden gemeld.

Artikel 14 – Privacy en contactgegevens

  1. Door deelname aan een singles event en/of matchmakingtraject stemt de Deelnemer ermee in dat The Love Doctor, uitsluitend in geval van een wederzijdse match, contactgegevens van Deelnemers onderling mag uitwisselen.

  2. Na het delen van contactgegevens dragen Deelnemers zelf de volledige verantwoordelijkheid voor het verdere contact.

  3. The Love Doctor is niet aansprakelijk voor situaties die ontstaan na het uitwisselen van contactgegevens.

Artikel 15 – Intellectueel eigendom

  1. Alle door The Love Doctor ontwikkelde concepten, formats, teksten, methodieken en werkwijzen blijven uitsluitend eigendom van The Love Doctor.

  2. Het is niet toegestaan deze zonder schriftelijke toestemming te kopiëren, te gebruiken of te verspreiden.

Artikel 16 – Wijziging algemene voorwaarden

  1. The Love Doctor behoudt zich het recht voor deze Algemene Voorwaarden te wijzigen.

  2. De meest actuele versie is altijd leidend en beschikbaar via de website.

Artikel 17 – Toepasselijk recht en forumkeuze

  1. Op alle overeenkomsten is uitsluitend Nederlands recht van toepassing.

  2. Geschillen worden voorgelegd aan de bevoegde rechter in het arrondissement Oost-Brabant.

These General Terms and Conditions apply to all services, events, and agreements offered by The Love Doctor.

Article 1 – Definitions

The Love Doctor: the sole proprietorship The Love Doctor, owned by Demi Drenth, established in the Netherlands, registered with the Chamber of Commerce under number 98887661, VAT number NL005360637B06.

Participant: any natural person who participates in a singles event or purchases a matchmaking service from The Love Doctor.

Event: a singles event, social gathering, or meeting organized by The Love Doctor.

Matchmaking Program: a personal and individual guidance program aimed at finding potential matches.

Agreement: any agreement between The Love Doctor and the Participant relating to events or matchmaking services.

Article 2 – Applicability

  1. These General Terms and Conditions apply to all offers, services, agreements, and legal relationships between The Love Doctor and the Participant.

  2. Deviations from these General Terms and Conditions are only valid if agreed upon in writing.

  3. By participating in an event or entering into a matchmaking program, the Participant agrees to these General Terms and Conditions.

Article 3 – Services

  1. The Love Doctor exclusively offers the following services:

    • Singles events;

    • Personal matchmaking programs.

  2. The Love Doctor has an obligation of best efforts and expressly no obligation of results.

Article 4 – Singles Events

Participation

  1. Participation in an event is only possible after purchasing a valid ticket.

  2. Tickets are personal, non-transferable, and may not be resold.

Tickets, Cancellation and No-Show
3. All tickets are NON-refundable.
4. Purchased tickets cannot be canceled, transferred to another event, or converted.
5. In case of absence or no-show by the Participant, no refund or compensation will be provided.

Cancellation or Changes by the Organizer
6. If The Love Doctor cancels or reschedules an event, the Participant is not entitled to a refund.
7. In such cases, the Participant may exchange the ticket once for participation in a future event organized by The Love Doctor.

Article 5 – Target Group, Admission and Conduct

  1. Events are intended for a specific target group, as communicated for each individual event.

  2. The Love Doctor reserves the right to refuse or exclude Participants who do not fall within the target group or who provide incorrect or incomplete information.

  3. Participants are required to behave respectfully towards other participants, the organization, and the venue.

  4. In the event of inappropriate, disruptive, or boundary-crossing behavior, The Love Doctor reserves the right to remove the Participant from the event without refund.

Article 6 – Liability at Events

  1. Participation in events is entirely at the Participant’s own risk.

  2. The Love Doctor is not liable for:

    • personal injury;

    • loss of or damage to personal property;

    • behavior of other participants;

    • emotional distress, disappointment, or discomfort.

Article 7 – Matchmaking Programs

  1. Matchmaking is a personal service in which The Love Doctor makes reasonable efforts to propose potential matches.

  2. The Love Doctor:

    • does not guarantee a minimum number of matches;

    • does not guarantee a successful match;

    • does not guarantee a relationship.

  3. It is possible that no match will be proposed.

  4. The Participant acknowledges that matchmaking is subjective and depends on availability, mutual interest, and personal preferences.

Article 8 – Duration and Extension of Matchmaking

  1. Matchmaking programs have an agreed indicative duration.

  2. If The Love Doctor believes that additional time is required to properly execute the program, it is entitled to extend the program without additional costs.

  3. An extension does not give rise to any right to a refund.

Article 9 – Payment for Matchmaking

  1. The Participant is obliged to pay the full amount of the agreed matchmaking program.

  2. This payment obligation remains in force:

    • even if the Participant finds a partner during the program;

    • even if the Participant terminates the program prematurely.

  3. No refunds will be granted once the program has commenced.

  4. Payment in installments does not release the Participant from the obligation to pay the full amount.

Article 10 – Termination of Matchmaking

  1. The Love Doctor is entitled to terminate the matchmaking program if:

    • the Participant provides incorrect or incomplete information;

    • the Participant fails to comply with agreements;

    • there is inappropriate or boundary-crossing behavior.

  2. Termination by either the Participant or The Love Doctor does not entitle the Participant to a refund, unless The Love Doctor decides otherwise in writing.

Article 11 – Liability (General)

  1. The liability of The Love Doctor is at all times limited to the amount paid out by its liability insurance.

  2. If no payment is made by the insurance, liability is limited to the invoice amount of the relevant service.

  3. Liability for indirect damage, consequential damage, or non-material damage is excluded.

Article 12 – Force Majeure

  1. Force majeure includes any circumstance beyond the control of The Love Doctor, including but not limited to illness, government measures, pandemics, extreme weather conditions, fire, technical failures, and venue unavailability.

  2. In cases of force majeure, The Love Doctor is not obliged to provide compensation or refunds.

  3. Where possible, The Love Doctor will offer an alternative, such as transferring participation to a future event.

Article 13 – Image and Media Use

  1. By purchasing a ticket for a singles event, the Participant grants permission for photographs and videos to be taken and used for marketing and promotional purposes.

  2. This permission is granted without entitlement to any compensation.

  3. If the Participant has serious objections to recognizable publication, this must be communicated in writing prior to the event.

Article 14 – Privacy and Exchange of Contact Details

  1. By participating in a singles event and/or matchmaking program, the Participant agrees that The Love Doctor may exchange contact details between Participants only in the event of a mutual match.

  2. After contact details have been shared, Participants bear full responsibility for any further communication.

  3. The Love Doctor is not liable for situations arising after the exchange of contact details.

Article 15 – Intellectual Property

  1. All concepts, formats, texts, methods, and working practices developed by The Love Doctor remain the exclusive intellectual property of The Love Doctor.

  2. These may not be copied, used, or distributed without prior written permission.

Article 16 – Amendment of Terms and Conditions

  1. The Love Doctor reserves the right to amend these General Terms and Conditions.

  2. The most current version will always be applicable and available via the website.

Article 17 – Governing Law and Jurisdiction

  1. All agreements are governed exclusively by Dutch law.

  2. Any disputes shall be submitted to the competent court in the district of Oost-Brabant.
